Terms and conditions

These terms govern your use of dufp.org. Please read them. Using the site means you accept them.

This document has been prepared carefully but it is not legal advice. Please have it reviewed by a qualified adviser in South Africa before publication.

1. Acceptance of Terms

These terms are an agreement between you and Development United For Progress (“DUFP”, “we”, “us”) covering your use of the dufp.org website.

What counts as acceptance. Using this website means you accept these terms. If you do not accept them, please do not use the site. Submitting the contact form, subscribing to the newsletter or downloading material from us are each a clear acceptance.

Age. You must be at least 18 to submit the contact form or subscribe to communications. Anyone may read the site. If you are under 18 and want to take part in a programme, please ask a parent, guardian or teacher to contact us on your behalf.

Changes. We may amend these terms. The date at the top of this page shows when we last did. Continuing to use the site after a change means you accept the amended version, so it is worth checking the date if you are relying on something specific.

2. Use of the Website

What you may do

  • Read, print and share our pages for your own information, for study, for teaching and for reporting.
  • Quote from us with attribution and, where practical, a link to the page you took it from.
  • Contact us through the form, by email or by telephone.
  • Link to any page on the site, provided you do not imply an endorsement, an approval or a relationship that does not exist.

What you may not do

  • Use the site for anything unlawful, or to encourage anyone else to.
  • Send abusive, threatening, defamatory, obscene or harassing content through the contact form.
  • Submit anything that contains a virus, worm or other harmful code.
  • Scrape, harvest or systematically extract content or contact details, whether by hand or by automated means, including for the purpose of training a machine learning model, without our written permission.
  • Attempt to gain unauthorised access to the site, the hosting account or any connected system, or probe or test their security.
  • Interfere with the site's availability, including by flooding the contact form or attempting a denial of service.
  • Impersonate anyone, or misrepresent your affiliation with a person or organisation, when contacting us.
  • Remove or obscure any copyright, trademark or other proprietary notice.
  • Frame or mirror the site, or present our content as your own.

We may block access, without notice, where we reasonably believe any of the above is happening.

3. Intellectual Property

Ownership. Unless something says otherwise, everything on this website, including the text, layout, graphics, photographs, code and the arrangement of it all, is owned by Development United For Progress or used by us under licence.

Copyright. © Development United For Progress. All rights reserved. You may read, print and quote from the site as set out above. You may not republish it in bulk, sell it, or use it as the basis of a commercial product or a training dataset without our written permission.

Trademarks. The DUFP name and our logo are ours. You may not use them without written permission, and you may not use them in a way that suggests we endorse, sponsor or are affiliated with you when we are not.

Third party material. Some photographs and typefaces are used under licence from their creators. Those licences run to us, not to you, so please do not lift an image from our pages for your own use.

Requests. If you would like to reuse something, ask us at z@dufp.org. We say yes more often than not, particularly for teaching and research.

4. Content You Submit

The contact form is the only route by which you can send us content. This section covers what happens to it.

  • You keep ownership. Nothing you send us stops being yours.
  • The licence you give us. By submitting the form you give us permission to read your message, store it, and use it internally for the purpose of answering you and running our work. That permission is limited to what we need in order to respond.
  • We will not publish it without asking. We will not quote you publicly, in a report, on social media or in a case study, unless we have asked you and you have agreed.
  • You confirm you are entitled to send it. Please only send us material that is yours to send, and that does not infringe anyone else's rights or breach a confidence you owe to someone else.
  • Do not send us confidential or sensitive material. Email is not a secure channel. Please do not put health information, identity document numbers, financial details or anything you would not want read by a third party into the form. Contact us first and we will arrange a suitable method.
  • Unsolicited ideas. If you send us a proposal or idea we have not asked for, we cannot treat it as confidential and we cannot promise not to be working on something similar already.

5. Accuracy of Information

We take care over what we publish and we correct mistakes when we find them or when someone points one out. Even so, please read the following before you rely on anything here.

  • Content is provided for general information. It is not professional advice and should not be treated as a substitute for advice about your own situation from someone qualified to give it.
  • Programme details, dates, eligibility criteria and figures can change. A place, a grant or an outcome is confirmed only when we have confirmed it to you in writing.
  • We do not warrant that the site is complete, current or free of error, and pages may be out of date without being marked as such.
  • Any statistic we publish reflects the method described alongside it. Ask us at z@dufp.org if you need the underlying method before citing a figure.

We link to other organisations where it is useful to you.

  • A link is not an endorsement of that organisation, its content, its products or its practices.
  • We do not control external sites and we are not responsible for what is on them, for what they do with your data or for any loss arising from your use of them.
  • Once you follow a link, this agreement and our Privacy Policy stop applying and theirs take over. Please read them.
  • Links can rot. Tell us if you find one that is broken or now points somewhere unexpected and we will fix it.

7. Disclaimers and Liability

Nothing in these terms excludes or limits liability where the law does not allow it to be excluded or limited, including for death or personal injury caused by our negligence, for fraud, or under the Consumer Protection Act 68 of 2008 where it applies to you.

Disclaimer of warranties

The website is provided on an “as is” and “as available” basis. To the extent the law allows, we give no warranty that it will be uninterrupted, timely, secure, error free or free of harmful components, and we disclaim the implied warranties of merchantability, fitness for a particular purpose and non infringement.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, data, goodwill or anticipated savings, arising from your use of or inability to use the website, whether the claim is in contract, in delict or tort, or otherwise.

Where liability cannot be excluded, our total liability arising out of or in connection with the website is limited to the greater of the amount you have paid us in the twelve months before the claim, or the equivalent of one hundred units of the local currency.

8. Indemnification

You agree to indemnify Development United For Progress, and our trustees, directors, officers, employees and volunteers, against any claim, demand, loss, liability or reasonable cost, including reasonable legal fees, arising from:

  • your breach of these terms;
  • your use of the website in a way these terms prohibit;
  • content you submit to us that infringes someone else's rights or breaks the law; or
  • your infringement of any intellectual property or other right of any person.

We will tell you promptly about any claim we intend to rely on this section for, and we will not settle a claim in a way that imposes an obligation on you without asking you first.

9. Governing Law and Jurisdiction

These terms, and any dispute arising out of them or out of your use of the website, are governed by the laws of the Republic of South Africa, without regard to its conflict of laws rules.

You and we agree to submit to the exclusive jurisdiction of the courts of the Western Cape Division of the High Court of South Africa.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your own country, or of the right to bring proceedings there where that law gives it to you.

We would much rather resolve a problem directly. Please write to us at z@dufp.org before starting anything formal, and we will make a genuine attempt to sort it out.

10. Suspension and Termination

We may suspend, restrict or withdraw access to the website, in whole or in part, at any time and without notice, where we reasonably believe you have breached these terms, where we need to protect the site or other users, or where we are required to by law.

We may also change, suspend or discontinue any part of the site, or the whole of it, without notice and without liability to you.

The sections on intellectual property, content you submit, disclaimers and liability, indemnification and governing law survive any termination.

You may stop using the site at any time. If you would like your data deleted when you go, see the rights section of our Privacy Policy.

11. General

  • Whole agreement. These terms, together with our Privacy Policy and Cookie Policy, are the whole of the agreement between us about the website.
  • Severability. If a court finds any part unenforceable, that part is severed and the rest continues to apply.
  • No waiver. If we do not enforce a right immediately, that is not a waiver of it.
  • Assignment. You may not transfer your rights under these terms. We may transfer ours as part of a reorganisation or merger, and your rights will not be reduced by that.
  • No third party rights. These terms do not give rights to anyone who is not a party to them.
  • Language. These terms are written in English, and the English version governs.
